DMCA & COPYRIGHT POLICY

Last updated: May 2026

1. Introduction

AmaFans respects the intellectual property rights of all creators and third parties. We take copyright infringement seriously and will act promptly on valid takedown notices.

This policy applies to all content hosted on AmaFans and is consistent with the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) of South Africa, which provides similar protections to the US Digital Millennium Copyright Act (DMCA).

2. Reporting Copyright Infringement

If you believe content on AmaFans infringes your copyright, submit a takedown notice to:

Email: support@amafans.co.za Subject line: Copyright Takedown Notice

Your notice must include:

  • Your full name and contact details

  • A description of the copyrighted work you believe has been infringed

  • The exact URL(s) of the infringing content on AmaFans

  • A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law

  • A statement that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf

  • Your physical or electronic signature

Incomplete notices may not be actioned. False notices may expose you to legal liability.

3. What Happens After You Submit a Notice

Once we receive a valid takedown notice we will:

  • Review the notice within 5 business days

  • Remove or disable access to the allegedly infringing content if the notice is valid

  • Notify the Creator whose content has been removed

  • Provide the Creator with a copy of the takedown notice (with your contact details)

4. Counter-Notice

If your content was removed and you believe it was done in error, you may submit a counter-notice to support@amafans.co.za including:

  • Your full name and contact details

  • Identification of the content that was removed and its former location

  • A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification

  • Your physical or electronic signature

  • Your consent to the jurisdiction of the South African courts

If we receive a valid counter-notice we will reinstate the content within 10 to 14 business days unless the original complainant obtains a court order preventing reinstatement.

5. Repeat Infringers

AmaFans operates a strict repeat infringer policy. Accounts that repeatedly infringe third-party intellectual property rights will be permanently terminated without warning.

6. Creator Content Protection

AmaFans actively supports Creators in protecting their content:

  • We will submit takedown notices on your behalf to third-party platforms hosting your content without permission — contact support@amafans.co.za

  • We watermark downloadable content with unique fan identifiers to trace leaks back to source

  • We cooperate with legal proceedings brought by Creators against fans who illegally distribute their content

7. South African Law

This policy is governed by the Electronic Communications and Transactions Act 25 of 2002 and the Copyright Act 98 of 1978 of South Africa. All disputes arising from this policy are subject to South African jurisdiction.
