CONTRACT BETWEEN FAN AND CREATOR

1. Introduction

This Contract between Fan and Creator ("Agreement") governs every interaction between a Fan and a Creator on AmaFans. This includes subscriptions, pay-per-view (PPV) purchases, tips, direct messages, and any other paid interaction.

AmaFans facilitates these interactions by providing the platform but is not a party to this Agreement. The contractual relationship is directly between the Fan and the Creator.

2. The Creator's Obligations

By accepting a Fan Payment, the Creator agrees to:

  • Deliver the Content or interaction the Fan has paid for within a reasonable time

  • Ensure all Content is legal, original, and compliant with AmaFans Terms of Service

  • Maintain an active account and honour all active subscriptions

  • Respond to Fan messages within a reasonable period where messaging is included in the subscription

  • Not misrepresent the nature, quality, or type of Content offered

  • Ensure all persons appearing in Content have given informed written consent and are at least 18 years old

  • Not share a Fan's personal information with any third party without the Fan's consent

3. The Fan's Obligations

By making a Fan Payment, the Fan agrees to:

  • Pay the agreed subscription or purchase price in full

  • Use Content solely for personal, non-commercial use

  • Not download, screenshot, record, redistribute, or share any Creator Content without the Creator's written permission

  • Not harass, threaten, or abuse any Creator

  • Not make unjustified refund or chargeback requests

  • Not attempt to obtain Content through fraudulent means

4. Subscriptions

  • Subscriptions grant Fans access to a Creator's content for the duration of the subscription period

  • Subscriptions renew automatically each month unless cancelled by the Fan

  • Cancellation takes effect at the end of the current billing period — Fans retain access until expiry

  • Subscription prices are set by the Creator, up to a maximum of R60/month

  • Price increases require advance notice to existing subscribers

5. Pay-Per-View (PPV) Content

  • PPV Content is individually priced content unlocked by a one-time payment

  • PPV purchases are non-refundable once the Content has been accessed

  • Creators must accurately describe PPV Content before purchase

  • Fans may not share or redistribute PPV Content under any circumstances

6. Tips

  • Fans may send tips to Creators at any time as a voluntary payment

  • Tips are non-refundable

  • Tips do not entitle the Fan to any specific Content or interaction unless explicitly agreed with the Creator

7. Direct Messages

  • Creators may charge for direct message interactions

  • Paid message interactions are non-refundable once the Creator has responded

  • Both parties must conduct themselves respectfully in all message interactions

  • AmaFans may monitor messages for compliance with platform policies

8. In-Person Bookings

  • Creators may offer in-person bookings for appearances, events, or private sessions through the platform

  • All in-person booking terms (price, location, duration, cancellation policy) must be agreed between Fan and Creator before payment

  • AmaFans facilitates payment only and is not responsible for the conduct of either party at in-person events

  • In-person bookings involving explicit or adult services are subject to all applicable South African laws

9. Content Ownership and Licence

  • Creators retain full ownership of their Content

  • By subscribing or purchasing Content, Fans receive a limited, personal, non-transferable licence to view the Content on AmaFans

  • This licence does not permit downloading, copying, sharing, or any commercial use of the Content

  • Any unauthorised use of Creator Content may constitute copyright infringement under South African law

10. Refunds and Disputes

  • Refund requests must be submitted within 7 days of the relevant Fan Payment

  • Refunds may be considered where: the Creator failed to deliver promised Content, the Content materially misrepresented what was advertised, or technical errors caused duplicate charges

  • Refunds will not be granted for change of mind, dissatisfaction with legal Content delivered as described, or where Content was accessed prior to the refund request

  • Dispute resolution: Fans and Creators should first attempt to resolve disputes directly. Unresolved disputes may be escalated to AmaFans via support@amafans.co.za

11. Prohibited Conduct

Neither Fans nor Creators may:

  • Attempt to conduct transactions outside the AmaFans platform to avoid platform fees

  • Share login credentials or account access with third parties

  • Use the platform for money laundering or any other financial crime

  • Impersonate another Creator or Fan

  • Use automated tools to interact with the platform without our written permission

12. Termination of the Fan-Creator Relationship

  • Either party may end the subscription relationship at any time

  • Creators may block or restrict individual Fans at their discretion

  • AmaFans may terminate the agreement between a Fan and Creator where either party breaches these terms or the AmaFans Terms of Service

13. Governing Law

This Agreement is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Films and Publications Act 65 of 1996.
